Couple accused of assaulting an unidentified 1-year-old
GRAND RAPIDS TOWNSHIP, MI – No plea deal was offered – and it is unlikely one will be coming – for a Comstock Park couple accused of video recording their rape of a 1-year-old girl.
Stevie Marie Foehl, 23, and Michael Justin Emory, 25, were in Kent County District Court Wednesday, Sept. 11, when they waived their right to have the prosecution present evidence to a judge who would then decide if the case had merit to move to felony court.
Both are charged with multiple counts of child sexual abuse and computer crimes resulting from the alleged sexual assault that occurred in an Alpine Township apartment.
During the brief hearing, Judge Sara Smolenski asked if the waivers were to preserve negotiations with the Kent County Prosecutor’s Office for a possible plea agreement.
“No offer has been discussed and it is possible no offer will be made,” Chief Assistant Prosecutor Christopher Becker said. “Probably it will be up to them to decide if they want to take it to court or plead.”
The couple was extradited to Michigan from South Carolina, where they were arrested Aug. 16 on a warrant alleging the couple had sexually abused and recorded the attack on an unidentified baby girl in their York Creek apartment last year.
Ottawa County authorities earlier this summer searched the couple’s apartment after a teen reported she had been sexually assaulted by Emory when she came to babysit for the couple.
In the apartment, police found videos and photographs of child pornography that included the unidentified baby, according to court records.
The couple took turns recording one another assaulting the child sometime around Oct. 25, 2012, police say. Emory is accused of committing at least three sexual acts with the baby.
Ottawa County authorities alerted investigators at the Kent County Sheriff’s Department to the alleged evidence of the crimes.
The two now move to Kent County Circuit Court on charges of first-degree criminal sexual conduct, child sexually abusive activity and using a computer to commit a crime.
Foehl face one count of first-degree criminal sexual conduct while Emmory is charged with three counts.
Emory also faces an additional charge of third-degree criminal sexual conduct relating to the teen babysitter in the Hudsonville District Court.
There are no court dates scheduled in that case.
